Planning enforcement legal framework
The primary legislation for enforcing planning control is the Town and Country Planning Act 1990, as amended. This is supported by statutory guidance.
Parliament has given Local Planning Authorities the primary responsibility for taking whatever enforcement action may be necessary, in the public interest, within their administration area.
The Ribble Valley Borough Council ("the Council") is the Local Planning Authority ("LPA") in respect of certain planning matters within the Ribble Valley area.
If careful attention is not paid to resolving breaches of planning control it can seriously undermine the value of the planning system and often damage the environmental gains that are its objectives.
